2.1) The customer hereby acknowledges and accepts that www.matrimonial.com is only a website providing information uploaded by other users.
2.2) The customer hereby acknowledges and accepts that matrimonial.com and its website act solely as an intermediary platform, enabling users to register themselves by filling out the mandatory and optional fields, to voluntarily search for profiles from the database of already registered users. This is intended for seeking prospective lawful matrimonial alliances, either for themselves or for their family members (such as their daughter or son). The registered office of matrimonial.com, along with its various franchisees/branches, may assist the customer in creating their profile. However, the customer is aware that they need to provide accurate and true information, including their operational and valid phone number and email address.
3.1) The customer agrees and acknowledges that their intention is to seek prospective lawful matrimonial alliances for themselves.
3.2) The customer must read, agree with, and accept all of the terms and conditions contained in this User Agreement and the Privacy Policy before becoming a member of matrimonial.com.
3.3) By using and/or accessing the services of matrimonial.com and the website, the customer agrees to be bound by all the terms and conditions.
3.4) The customer must provide their full legal name, current address, a valid email address, mobile phone number, and all other information needed to complete the signup process.
3.5) The customer acknowledges and accepts that matrimonial.com will use the email address and mobile phone number provided as the primary method for communication.
3.6) The customer is responsible for keeping their password secure. matrimonial.com cannot and will not be liable for any loss or damage due to the failure to maintain the security of the account and password.
3.7) The customer shall not transmit any worms, spam, viruses, or any code of a destructive nature.
3.8) The customer shall not use the services provided by matrimonial.com for any illegal or unauthorized purpose, nor shall they, in using the Service, violate any laws in their jurisdiction.
3.9) Any person who disagrees with any of the terms and conditions mentioned herein shall not access and use this website.
3.10) The customer agrees and acknowledges that they are aware of matrimonial.com’s policy regarding multiple profiles of the same person. matrimonial.com reserves the right to deactivate/block such additional profiles without notice and refund of fees; such profiles are non-transferable.
3.11) The customer shall not use the website to promote other matrimonial services, websites, matrimonial apps, matrimonial companies, etc.
3.12) The customer agrees and acknowledges that the website shall be used only for non-commercial purposes.
3.13) The customer agrees and acknowledges that matrimonial.com primarily caters to the community of Indian origin.
3.14) The customer agrees and acknowledges that any kind of registration on matrimonial.com requires an Aadhar Card link for valid registration. Without an Aadhar Card link, registration cannot be displayed or accepted by matrimonial.com.
4.1) The security of the customer's personal information is important to matrimonial.com.
4.2) To secure the bank details of the customer, matrimonial.com provides the best possible third-party payment gateway on the website. The customer must review the terms and conditions of the payment gateway in case of any doubts.
4.3) matrimonial.com has reasonable processes and systems in place to maintain the confidentiality of all personal information, other than those meant for sharing with prospects furnished by the customer.
4.4) However, any feedback provided by the customer to matrimonial.com shall be deemed to be non-confidential. The customer acknowledges and accepts that matrimonial.com is free to use such feedback without any restriction. By submitting feedback, the customer also acknowledges that it does not contain any confidential information of themselves or any third party. Therefore, the customer is not entitled to claim any compensation, damages, or reimbursement of any kind from matrimonial.com for the feedback.
4.5) The customer acknowledges and accepts that matrimonial.com has all the rights to process the information provided by the customer through the automated process so that matrimonial.com can provide suitable matches from the database and may also send communication to the customer in this regard.
4.6) Please read and understand the privacy policy of matrimonial.com, which also governs the customer's visit to the website to understand our practices.
5.1) matrimonial.com does not warrant that any information or documents uploaded by other customers on the website will meet the customer’s expectations. The primary role of matrimonial.com is to act as an 'intermediary' and provide a platform to find prospective lawful alliances. The website only provides a platform and contains various profiles with information provided and uploaded by the customers themselves.
6.1) Payments made by cash, cheque, debit card, credit card, NEFT, net banking, etc., will be in accordance with the prevailing RBI guidelines.
6.2) The payment made to the 'intermediary,' matrimonial.com, is only for accessing the profiles uploaded by other users on the website.
6.3) For the convenience of the customer, a third-party payment gateway is provided on the website to facilitate online payments for the intermediary services of matrimonial.com.
6.4) Activation of matrimonial.com services is subject to the realization of payment.
6.5) In case of dishonor of a cheque, the customer shall be liable to pay any extra charges charged by the bank.
6.6) The customer acknowledges and accepts that if the account is activated before the realization of payment after the dishonor of a cheque, matrimonial.com reserves the right to deactivate the account without informing the customer.
6.7) The customer also acknowledges and accepts that fees paid to matrimonial.com by cash, cheque, debit card, credit card, NEFT, net banking, etc., are non-transferable and non-refundable.
6.8) The customer is requested to utilize the clicks offered with the package within the given time limit. Unused clicks will not carry over to the new package after the membership plan expires.
7.1) In no case shall the customer hold matrimonial.com responsible for information uploaded by other customers.
7.2) The customer shall complete the registration procedure with complete honesty and fairness.
7.3) The customer acknowledges and accepts that matrimonial.com provides services to help find a life partner through automated searching, shortlisting, and contacting prospects among registered members.
7.4) The customer acknowledges and accepts that once they register on the website, matrimonial.com shares their details on an "as is, where is" basis and with other members within the MCL consortium of websites.
7.5) The website provides an interface for registered members to search for life partners without assistance from third parties.
7.6) The customer agrees and acknowledges that system-generated search results only include profiles of registered members of matrimonial.com.
7.7) The customer agrees and acknowledges that automated system-generated results are based on the partner preferences set by each member in comparison to the customer’s profile.
7.8) The customer agrees and acknowledges that matrimonial.com cannot guarantee or assume responsibility for any specific results from the use of data available from matrimonial.com services or the consortium of websites.
7.9) The customer agrees and acknowledges that matrimonial.com may allow third parties to provide services like 'kundali,' horoscope, etc. However, matrimonial.com shall not be held responsible for the services provided by third parties and may collect payment for such services on behalf of the third parties.
8.1) The customer shall keep their username and password safe and shall not share them with any third parties.
8.2) In case of any modification in the customer’s profile, the automated system-generated results may also change.
8.3) The customer shall exercise due care and caution while relying on information provided by other members of matrimonial.com and before shortlisting liked profiles. The customer should perform due diligence before making a choice of match.
8.4) The customer agrees and acknowledges that matrimonial.com shall not be held responsible for any misrepresentation made by its other members.
8.5) The customer agrees and acknowledges that matrimonial.com has not verified the information provided by other members, and the customer is expected to verify the contents and credentials of prospects, such as family background, annual income, degree, educational background, character, occupation, health status, marital status, location, etc.
8.6) The customer agrees and acknowledges that they should provide their latest photograph for better results and that photographs of third parties should not be uploaded.
8.7) The customer agrees and acknowledges that the purpose of registration with matrimonial.com is solely to find a matrimonial prospect.
9.1) matrimonial.com may offer a service known as "Featured Ads," where other service providers may pay a non-refundable and non-transferable fee to have their ads posted in selected locations on the website, potentially increasing the ad's visibility.
9.2) However, matrimonial.com shall not be held liable if any featured ads uploaded by other service providers do not meet the customer's expectations. Featuring any advertisement on the website does not imply that it guarantees the quality of its products or services, nor does it indicate that matrimonial.com supports the said advertisements.
10.1) matrimonial.com owns the intellectual property rights for all content other than what is uploaded and posted by customers themselves. matrimonial.com will take necessary legal action in case of any infringement.
10.2) The customer agrees not to engage in any activities that would infringe upon the intellectual property rights owned and possessed by matrimonial.com.
11.1) The customer agrees and acknowledges that matrimonial.com shall use the e-mail address, phone number, etc., provided by the customer as a medium of communication with the customer.
11.2) The customer agrees and acknowledges that matrimonial.com may, by way of e-mail, voice call, recorded call, SMS, etc., provide information about additional/new services and other activities of matrimonial.com. The customer agrees and acknowledges that the mobile number provided by the customer is not registered with the “do not disturb” category.
11.3) The customer agrees and acknowledges that immediately after registering with matrimonial.com, they have given consent to such e-mails, voice calls, recorded calls, SMS, etc., as stated above, and in case of such communication by matrimonial.com, the customer shall not make any complaint to any authority. Such communications shall not be treated as promotional calls, etc.
12.1) The customer agrees to defend, indemnify, and hold harmless matrimonial.com, its officers, assigns, and employees, from and against any and all claims, damages, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys' fees) arising from:
This clause will survive termination, modification, or expiration of these Terms and Conditions, meaning that the said violation shall not relieve the customer of the obligations arising or accruing prior to such violation.
13.1) The customer using the website should abide by the membership eligibility criteria, being above 18 years of age if the customer is a woman, and 21 years of age if the customer is a man.
13.2) The customer shall be of sound mind.
13.3) The customer shall be eligible to enter into a valid matrimonial contract.
13.4) In case the customer is in violation of these terms and conditions, matrimonial.com shall not be held responsible in any case.
14.1) The customer using the website should abide by the membership eligibility criteria, being above 18 years of age if the customer is a woman, and 21 years of age if the customer is a man.
14.2) The customer shall be legally competent to marry as per the law applicable to the customer.
14.3) The customer agrees and acknowledges that they are not prohibited or prevented by any law applicable for the time being in force from entering into a valid marriage.
14.4) The customer shall not use any images or information provided on the site for any recreational or pornographic purposes; or repost any advertisement of this site to other mediums claiming it as their own and utilize its benefits.
15.1) For the online payment options, kindly read the terms and conditions of our payment gateway.
16.1) The customer agrees and acknowledges that one month prior to the expiry of the period of membership, the renewal option will be kept open. For example, if membership expires on August 31, 2017, the option for renewal will open on July 31, 2017.
16.2) The customer agrees and acknowledges that if the membership is renewed after the period of one month from the date of expiry of membership, it may be treated as new membership. For example, if membership expires on August 31, 2017, and the membership is renewed on October 01, 2017, it may be treated as new membership.
16.3) The customer agrees and acknowledges that during the period of membership, the customer cannot keep the membership on hold under any event or circumstances.
17.1) The customer agrees and acknowledges that they shall not hold matrimonial.com responsible for any dispute that has arisen with other members.
17.2) The customer agrees and acknowledges that they are solely responsible for the acts and communications done by them on the website.
17.3) The customer agrees and acknowledges that matrimonial.com and the website are not acting as brokers for any customer (prospect, match, etc.).
17.4) The customer agrees and acknowledges that they do not want matrimonial.com to have any obligation to monitor such disputes. The customer also agrees and acknowledges that matrimonial.com shall not be made a party in case of such disputes.
17.5) matrimonial.com has no obligation of whatsoever nature to monitor such disputes, and matrimonial.com shall not be added as a party to the same.
18.1) The customer registered with matrimonial.com and availing any of the services of matrimonial.com, including the website, is deemed to have entered within the territorial jurisdiction of Mumbai, Maharashtra, India.
18.2) The customer acknowledges and accepts unconditionally that in case of any dispute or differences, they shall be governed by the laws of the Republic of India and shall have exclusive jurisdiction of the appropriate court of law in Mumbai, Maharashtra, India only.
19.1) The customer agrees and acknowledges that www.matrimonial.com is a domain registered in the name of matrimonial.com Pvt. Ltd. The customer agrees and accepts that the content appearing on the website, excluding content provided by customers and advertisements, belongs to matrimonial.com.
19.2) The customer agrees and acknowledges that they are responsible for the content (optional and mandatory) provided by them appearing on the website in their profile, including all the posts and communication with other customers. The customer agrees and acknowledges that they alone are the owner of all the content appearing on their profile on the website.
19.3) However, the customer also agrees and acknowledges that by submitting such content on the website, they have given a license to matrimonial.com to use the content anywhere worldwide. This worldwide license is royalty-free, transferable to any other licensee. The customer also agrees and acknowledges that matrimonial.com shall be free to publish, display, advertise such content anywhere, make a public display of the same, distribute it, etc. The customer also agrees and accepts that matrimonial.com, if needed, shall provide such content to law enforcement agencies, produce it before a court of law, etc.
19.4) matrimonial.com reserves its rights to initiate appropriate legal proceedings against the customer for infringement of the proprietary rights of matrimonial.com. In case proprietary information of matrimonial.com is copied, modified, transmitted, published, distributed, used, etc., in any manner whatsoever by the customer for commercial purposes, matrimonial.com reserves its rights to take appropriate legal action against such a customer.
19.5) The customer also agrees that the content provided by the customer may be deleted by matrimonial.com without any notice if it is found to be offensive, harmful, illegal, defamatory, obscene, or against public policy.
19.6) Customers who are registered on www.matrimonial.com will be receiving all types of communications via SMS, email, and calls.
20.1) The customer agrees and acknowledges that matrimonial.com, suo motu or if matrimonial.com receives any complaint from other customers that the customer is using the profile for purposes other than finding a prospective lawful matrimonial alliance, such as physical favors, financial help, any type of personal relationship other than marriage, or that the information provided on the profile is not true, fake, false, or misrepresenting, matrimonial.com has all rights to terminate the customer’s membership and deactivate the account/profile without any notice. In such cases, the provisions stated in clause no. 25 ‘Termination’ shall apply.
21.1) The customer agrees and acknowledges that matrimonial.com provides two different packages. These packages are mentioned below, starting from the best to the basic package:
21.2) The customer agrees and acknowledges that matrimonial.com will charge an extra amount for services like “Profile of the Month” and “Highlighted Profile”.
21.3) The customer agrees and acknowledges that every member of matrimonial.com shall take the Diamond package.
21.3.1) A matrimonial.com mentor will meet you in person at matrimonial.com’s Dadar, Borivali, or Thane office. If a meeting at these locations is not possible, a detailed telephonic conversation with the mentor is advised.
21.3.2) Premarital Counseling is available at Dadar/Borivali/Thane office.
21.3.3) If you have an unusual case like a second marriage/divorcee, medical or health issues, financial problems, or any other issues which may result in difficulty in finding a perfect match for you, then we may not be able to suggest 25 profiles in one year. In such cases, only after a detailed discussion with you, we will decide the scope of matrimonial.com Service. You shall disclose this to the mentor in the first meeting itself.
21.3.4) The Diamond membership package shall expire upon getting your marriage fixed or after one year, whichever is earlier. Please note that the Diamond membership is non-transferable and non-refundable.
21.3.5) matrimonial.com does not provide the service of any independent investigation of profiles suggested to you.
21.3.6) All rights about the Diamond membership are reserved with matrimonial.com.
21.3.7) Even if profiles suggested by us are already seen and considered by you, either on matrimonial.com platform or through any other medium, matrimonial.com shall count them in suggested profiles.
21.3.8) The matrimonial.com Diamond package service shall commence on your signature and confirmation to these rules.
21.4) Terms and conditions of the ‘Free Membership’ Package: The customer agrees and acknowledges that matrimonial.com has created this platform for a limited period only. Customers who register under Free Membership agree and acknowledge that the information given by free membership customers is not thoroughly verified. matrimonial.com cannot be held responsible for any breaches or unknown issues that arise.
21.4.1) Customers registered under this package are not entitled to get contact details of paid/unpaid customers.
21.4.2) The Free Membership package shall expire upon getting your marriage fixed or after one year, whichever is earlier. Please note that the Free Membership package is non-transferable.
21.4.3) matrimonial.com does not provide any services to Free Membership customers.
21.4.4) All rights about the Free Membership package are reserved with matrimonial.com.
21.4.5) The matrimonial.com Free Membership package service shall commence on your signature and confirmation to these rules and submission of ID Proof like Aadhar Card.

23.1) The customer agrees and acknowledges that matrimonial.com is a third party, and any exchange of profiles through matrimonial.com shall not, in any case, be held as a matrimonial offer, advice, recommendation, suggestion, or any kind of guarantee by matrimonial.com.
23.2) In no case shall matrimonial.com, its directors, any of the officers, staff, employees, power of attorneys, authorized representatives, etc., be held responsible for any direct, indirect, incidental, or consequential damage resulting from the use of the website or services provided by matrimonial.com.
23.3) In no case shall the liability of matrimonial.com exceeded the amount paid by the customer to matrimonial.com for the membership.
23.4) The customer agrees and acknowledges that matrimonial.com shall not be held responsible in case of a wrong match or if the couple gets divorced after marriage.
23.5) The customer agrees and acknowledges that the employees, office bearers, staff, etc., of matrimonial.com shall not be held responsible if staff members approach other members with marriage proposals and the other members do not respond back.
23.6) The customer agrees and acknowledges that the employees, office bearers, staff, etc., of matrimonial.com shall not be held responsible if the customer enters into an agreement with other members of matrimonial.com.
24.1) The customer agrees and acknowledges that matrimonial.com may provide a ‘verification tick’ on the profile after comparing the documents provided by the customer with the information provided in their profile.
24.2) The customer agrees and acknowledges that the verification is only limited to the documents provided by the customer. The verification does not extend to information for which no document is provided by the customer.
24.3) The customer agrees and acknowledges that matrimonial.com has accepted the documents provided by the customer. matrimonial.com shall not be held responsible if the documents provided are forged, false, incorrect, tampered, etc.
24.4) The customer agrees and acknowledges that it is not the responsibility of matrimonial.com to investigate and/or check the validity of such documents. For example, if a degree certificate is provided by the customer, it is not matrimonial.com’s duty to check the records of the university for the validity of the document.
24.5) The customer agrees and acknowledges that the ‘verification tick’ is in no way a guarantee or surety by matrimonial.com.
24.6) The customer agrees and acknowledges their responsibility to cross-check the validity of documents with the information provided by other members, even if such a member has a ‘verified tick’ in front of their profile.
25.1) The customer agrees and acknowledges that matrimonial.com has every right to terminate their membership in case of failure to follow any of the terms and conditions, without any notice and without furnishing any reason. In the case of termination, the customer agrees that all amounts paid to matrimonial.com shall be forfeited.
25.2) The customer agrees and acknowledges that in the case of termination, the right to use the services of matrimonial.com, including the website, shall cease immediately.
This clause will survive termination, modification, or expiration of these Terms and Conditions, meaning that termination shall not relieve the customer of obligations arising or accruing prior to such termination.
